SHORT TERM RENTAL POLICY
Due to guidance from our insurance carrier, short term rentals are NOT PERMITTED at Deer Lofts HOA.
Short term rentals platforms can include but not limited to the following:
AirBNB
VRBO / Vacation Rental by Owner
Home Away
Private Management Companies sourcing short term rentals
Penalties for Short Term Rentals
Effective May 12 – August 15, 2026: $5,000 PER DAY
Beginning August 16, 2026: $500 PER DAY
City-Wide Events: The Board may, at its discretion, change the fine of $5,000 per day during major city-wide events.
Fines will begin accruing on the earliest of: (1) the date the unit is listed on any short-term rental platform, or (2) the first date of actual occupancy by a short-term renter.
Fines will continue daily until the violation is fully cured.
SHORT-TERM RENTAL MONITORING
The Board uses short-term rental monitoring platforms that utilize AI technology to identify and report unauthorized short term rentals to the Board.
COLLECTION & PAYMENT TERMS
Swift collection action will be pursued. Any unpaid fines related to short-term rentals that remain unpaid for more than 30 days will result in a lien on the property.
Payment plans and debt forgiveness will not be offered for short-term rental fines.
Interest and late fees will accrue at the maximum rate permitted by law.
Unpaid fines will become a lien on your unit and collection proceedings will be pursued as per State of Georgia Law.
PROHIBITED ACTIVITIES
Owners and/or authorized tenants are not permitted to accept compensation for occupancy.
Owners and/or authorized tenants are not permitted to engage property managers, agents, or any third party to facilitate short-term rentals.
ENFORCEMENT PROCESS
Complaints and reports will be investigated.
Exceptions will not be made
Written notice of violation will be issued
Owners have the right to request a hearing
Penalties may include fines, suspension of privileges, and legal remedies
LEASING YOUR APARTMENT
Short term rentals are not to be confused with authorized leasing of your unit. As required by the Condominium Documents, any rental must have a rental permit. Rental permits are issued through the Board-approved vendor, Rental Monitoring Solutions (RMS). Rentals without a permit are a violation.
As of the April 1, 2026 report the building is at the maximum allowed rentals according to to Condominium Documents. You are able to add your name to the waiting list. There are currently 10 names on the rental list. It is not permitted to trade or sell rental list positions to other homeowners.
