Fine Schedule
The Board has adopted the following sanctions and fining schedule for a non-exhaustive list of violations of the Declaration, Bylaws and Rules and Regulations (the “Governing Documents”). The Board is additionally authorized to implement fines in lesser or greater amounts as determined from time to time by the Board depending on the situation and severity of a violation. This list is not comprehensive of all violation topics and associated fines.
Section 1: General provisions and definitions
The “Doubling Provision” means that repeat violations within any six-calendar month period will result in a fine of double the previous fine. As an example, if Occupant A of Unit 123 allows any pet to urinate in the hallways on March 1st and does not clean it up, a $50 fine will be assessed. If Occupant B of Unit 123 then allows any pet to urinate in the hallways on August 31st and does not clean it up, the fine will be doubled to $100.
The doubling provision applies to any infraction on the this page and any infraction levied by the Board of Directors.
In addition to fines, any damaged caused or service calls generated by a rules violation will result in the assessment of the repair cost or the cost of the service call. For example, if an occupant in Unit 123 stuffs a large cylindrical cushion into the trash chute and clogs it up, a $100 fine plus the cost of the service call to unclog the chute will be assessed against Unit 123.
Where a tenant, guest or owner incurs a violation, all fines and/or repairs will be assessed to the owner’s HOA account.
NOTE: These rules are intended to harmonize with the Declaration of Condominium for Deer Lofts Condominium Association, Inc., Bylaws, amendments thereto, and applicable Georgia law, the Declaration of Condominium for Deer Lofts Condominium Association, Inc. and its bylaws are controlling.
Section 2: Rules and Fine Schedule
Roof violations $500.00 per occurrence
Trespass onto the roof’s surface without written permission from a board member or the Property Manager to be on the roof’s surface for an approved purpose. An example of an approved purpose would be accessing the roof to repair an HVAC unit. An e-mail from any board member or the Property Manager granting permission to access the roof for such approved purpose constitutes “written permission.”
Where a resident enters the rooftop without authorization an inspection fee and repairs will be assessed to the homeowner.
There is no warning, the violation is automatic.
Tampering with building systems and infrastructure $500.00 per occurrence
Infrastructure includes but is not limited to the garage door, access system boxes (Door King entry system), gate control mechanism, video recording system components, fire control systems, elevator controls, water/sewer systems
"Tampering” does not include attempting to use manual overrides to open the gate or garage door in the event of a power outage or other problem involving entry or exit.
NOTE: Where tampering causes a system to fail, the repair and/or replace cost will be billed to the HOA account of the individual. The Deer Lofts Homeowner’s Association does not own or maintain the Mangum Street gate. All gate inquiries / issues must be addressed to Fulton Supply Lofts
There is no warning, the violation is automatic.
Leaving the any of the following access points / doors propped open and unattended. $250.00 per occurrence
The lobby door to the sidewalk
The interior lobby doors
Either garage swipe-controlled door by the elevator or the staircase by the trash room
The pedestrian door entering from the parking lot.
The overhead garage door entering from the parking lot. Do not press the stop button if you are staying at the garage door.
There is no warning, the violation is automatic.
At the discretion of the Board of directors, the following violations may have a warning or an automatic violation with a fine levied.
Amenity violations $50.00 per occurrence
Using the rooftop deck or the fitness center outside of posted hours of operation
Blocking the doors open of the amenities to bypass the timed entry restrictions of the security system.
Pet violations $50.00 per occurrence
Unleased pets in any common area of the condominium.
Failure to clean up after pets who urinate and/or defecate in any common area of the condominium to include but not limited to any area (parking lot and/or landscaped area) within the fenced area located in the rear of the building, garage, any stairwells, hallways, lobby and elevator.
Allowing pets in the laundry room, fitness center or rooftop deck.
Violations involving garbage, refuse, dumping and/or recycling
Trash container $50.00 per occurrence
Placing non-qualified household garbage in the trash container. “Non-household garbage” includes but is not limited to, cardboard boxes, construction waste, carpets/rugs, paint, bricks, mortar, plaster, plumbing, electrical conduit, sheet metal, bed frames, mattresses, box springs, drywall, concrete, pane glass, corrugated plastic sheets, toilets, scrap metal, furniture, appliances, electronics, sinks, etc.
Recycling Container $50.00 per occurrence
Cardboard boxes must be broken down and placed in the recycling container. \in the recycling container.
The recycling container is intended for aluminum, plastics and cardboard boxes. Glass, Styrofoam, polystyrene, food waste and any item described in section 6.1.1 is NOT permitted.
Dumping anywhere in the building and property $100.00 per occurrence
Placing any unwanted items (to include but not limited to: junk, chemicals, paints, discarded items, etc.) anywhere on the outdoor property, parking lot, curb and interior building . In addition to the fine, professional services will be hired to remove such items and billed back to the unit owner.
These items must be disposed of properly. If they are items that could qualify for "re-homing", use NextDoor.com, Facebook Marketplace or a service like Goodwill.
CHaRM the Center for Hard-To-Recycle Materials accepts many of the items listed above, some without charge. Where costs are involved they are minimal. More information is at www.ecocycle.org/charm.
Placing oversized items within the trash chute. $100.00 per occurrence
Where a service call is needed to correct the problem, the service call invoice amount will be added to the offenders HOA account. "Oversized items” means items which are likely to or do clog the trash chute.
Parking violations $50.00 per occurrence
Not pulling fully within assigned parking space, so that the vehicle unreasonably sticks out of the space and interferes with an access way.
NOTE: Vehicles should be pulled within approximately six inches of the wall or fence abutting the space. A presumption of unreasonableness exists where a vehicle is parked such that more than 6 inches of space exists between the vehicle and the all or fence abutting the space.
Parking in a space other than the space assigned to the respective unit. NOTE: in accordance with the Declaration of Condominium, such vehicles are also subject to being towed without notice at the owner’s expense.
Parking anywhere other than within a designated parking space, including the “X’ed out areas in the garage or outdoor parking lot.
Noise violations $50.00 per occurrence
Unreasonably loud behavior in the hallways and other common areas such that other residents of the condominium are disturbed.
Continuing to play music, television, etc., or engaging in other noisy activities within a unit which unreasonably disturb neighboring residents, after the neighbor has made good faith effort to request that such noise be abated or after having a written and/or email warning from the Property Manager concerning such noise.
Leasing of units
Short term leasing to include but not limited to AirBnB, HomeAway, VRBO, $500.00 per occurrence. This fie is automatic.
Each day a unit is listed occupied with an unauthorized short-term lease without board approval shall constitute as a separate offense. Thus the fine will be $500.00 per day for every day the short term lease customer occupies the unit. Compliance with all relevant provisions of the Declaration of Condominium is required to obtain approval to the lease.
The Deer Lofts Condominium Association actively monitors these websites and leasing using a third-party web monitoring service.
Leasing of units in violation of the covenants. $25.00 per day
NOTE: Each day a unit is leased without board approval shall constitute a separate offense. Thus the fine will be $25.00 per day for every day a unit remains leased without approval.
Compliance with all relevant provisions of the Declaration of Condominium is required to obtain approval to the lease. NOTE: Units with active unauthorized short-term rentals or other unauthorized leases will be subject to limited FOB access restrictions as described.

Missing information - Owner has failed to provide required information, despite multiple requests $100, can be applied monthly
Refused to provide information - Owner has explicitly refused to provide required information $100, can be applied monthly
Leaving personal property or debris in any common area. $50.00 per occurrence
Renovations
Performing unauthorized renovations or interior modifications without prior approval from the Architectural Controls Committee. $25.00 per occurrence. Contact the property management company for authorization.
Once unapproved renovations or modifications begin, a continuing fine of $25.00 per day will be assessed. In addition to these fines, all other remedies as outlined in the in the Declaration of Condominium are applicable.
Performing renovations outside of the following hours (see noise violations – section 6 for fine information) $50.00 per occurrence
Monday – Friday 8:00 AM – 7:00 PM
Saturday – Sunday 9:00 AM – 7:00 PM
Contractors or others performing work on the premises and not cleaning up the common areas such as hallways leading to and from the unit, the garage and parking lot areas, etc., at the end of each day’s work. $50.00 per occurrence.

Common areas
Any guest, resident or unit owner not cleaning up after themselves in ANY limited common element of the condominium. This can include but is not limited to not cleaning up spills, pet urination / feces in the common areas, construction debris/mess not cleaned up daily, trash left in public areas, etc. $50.00 per occurrence
