Account Delinquencies
As per the Declaration of Condominium, Bylaws and Rules of the Association, each homeowner is responsible for payment of items posted to the HOA Owner account to include but not limited to:
HOA monthly dues as set forth by the Board of Directors
Water sub metering bill provided to each owner account by the sub metering company
Special assessments issued by the Board of Directors
Fines and repairs levied by the Board of Directors
A delinquency is defined as any amount that is equal to 31 days or more past due. Homeowners with delinquencies are classified as “not in good standing”. Homeowners “not in good standing” are not able to fully participate in the benefits of the HOA.
Additional measures and charges for collection will be used as allowed by the State of Georgia. Any expense associated with the collection process, to include but not limited to:
Legal expenses
Postal/overnight services
Interest
Administrative fees
The following limited common area building access restrictions will apply to units with a delinquency:
Rooftop and fitness center access will be turned off.
Access from the exterior parking lot to the garage will be turned off. Access to the building will only be allowed from the Nelson ST SW entrance.
Where a car is parked in the garage and/or parking lot it will be towed without notice at the vehicle owner’s expense.
All FOB’s will be deactivated but one, no matter the number of occupants in the unit.
The “Directory Listing” in the callbox system will be hidden from view.
Internet cable to be physically cut
If an owner has a delinquency and is on the rental waiting list, their wait list spot will be voided. To be placed back on the list, the delinquency must be cleared. This will be treated as a new rental waitlist request and placed at the end of the list.
